Booking Terms

We’re so thrilled you’ve decided to join us. At book[ed], we believe travel should be beautifully curated, delightfully bookish, and just the right amount of indulgent. Think: unforgettable reads, great conversation, unique surroundings, and a killer itinerary.

Below you’ll find the terms and conditions for your retreat. They’re here to keep things clear, fair, and running smoothly—for you and our  fellow book[ed] guests. Take a moment to read through them before officially getting book[ed]. We can’t wait to read, relax, and reconnect with you.

These Retreat Booking Terms and Conditions (“Booking Terms”) apply to all retreat experiences, programs, events, or services (each, a “Retreat”) provided by the book(ed). society, LLC (“Company,” “we,” “our,” or “us”). By booking or participating in a Retreat, you (“you” or “Participant”) acknowledge that you have read, understood, and agree to be legally bound by these Booking Terms, our Terms of Use, and Privacy Policy, which are incorporated herein by reference (collectively, the “Terms”).

1.  Booking Confirmation

Your Retreat booking (the “Booking”) is confirmed once Company issues a written confirmation (email sufficient) after the receipt of the applicable Deposit (as defined below).  You must be at least 18 years old and capable of contracting in your own name to book a Retreat.  By making a Booking for or on behalf of another person or persons, you represent and warrant that you have obtained all required consents and authorizations to enter into these Booking Terms on their behalf.

If you are booking a Retreat on behalf of a minor (under age 18), you represent and warrant that you are the minor’s parent or legal guardian or have obtained express written authorization from the parent or legal guardian to make the booking and agree to these Booking Terms on their behalf. By making a Booking for a minor, you:

  • Consent to the minor’s participation in all Retreat activities, including travel and related programming;
  • Assume full responsibility and liability for the minor’s health, safety, conduct, and compliance with all Retreat policies, rules;
  • Agree to accompany the minor at the Retreat unless otherwise agreed to in writing by Company; and
  • Acknowledge that we may, at our sole discretion, refuse participation or require withdrawal of the minor if their conduct is unsafe, inappropriate, or disruptive.

Children under 16 are not permitted unless approved in writing by Company prior to making a Booking.  Some Retreats are not suitable for children and we reserve the right to deny participation to any minor for any program.

By providing your contact information, you consent to receive transactional and service-related communications electronically. We will communicate with you primarily by e-mail. You must accordingly check your e-mails on a regular basis for information about your Retreat or your Booking. We may, but are not obligated to, also contact you by telephone if we cannot, for whatever reason, contact you by e-mail.

2.  Deposit & Payments

A deposit in the amount indicated on the trip details page (the “Deposit”) is required to reserve your spot. ALL DEPOSITS ARE NON-REFUNDABLE AND NON-TRANSFERABLE.

Full and complete payment is due 90 days prior to the start of the Retreat (the “Full Payment Due Date”), unless otherwise stated. For any Retreats booked less than 90 days from the Retreat start date, the full and complete payment may be required at the time of booking to secure your spot. Company, in its sole discretion, may offer payment or installment plans for Retreats.  Please reach out to thefineprint@bookedsociety.com to discuss any payment plan requests.

If full payment is not made by Participant by the Full Payment Due Date, Company will first attempt to contact Participant to facilitate timely payment. If Participant is non-responsive or does not immediately remit any overdue payments, Company reserves the right to cause Participant to forfeit their place at the Retreat and Company is not required to issue any refund or credit for amounts already paid by Participant.

All payments must be made via the Site (unless otherwise agreed in writing by the Company); payments are processed via a third-party providers, as described in the Terms of Use. All payments shall be made in United States Dollars. Posted prices do not include any sales tax due (if any). You are responsible for any applicable taxes, fees, or currency conversion charges.

3.  Travel Costs & Insurance‍

You are solely responsible for arranging and paying for your own transportation to and from the Retreat location, including but not limited to, airfare, ground transportation, and other ancillary costs. Please review the Retreat details on the website(s) operated by Company at www.bookedsociety.com and any associated subdomains (the “Site”) carefully prior to making a Booking regarding what items are included in a Retreat. We are not responsible for cancelled, delayed, or missed flights, and no refunds or credits will be issued due to any travel disruptions caused by airlines, personal transportation issues, illness, or other personal circumstances. We strongly encourage you to purchase comprehensive travel insurance that covers health care, trip cancellation, delays, and force majeure events.

4. Cancellations by You

Cancellations must be submitted in writing to Company. Refunds will be issued as follows:

  • If a cancellation notice is submitted more than 90 days before the Retreat start date, Company will issue a refund of amounts already paid, minus the non-refundable Deposit retained by Company.
  • If a cancellation notice is submitted more between 90 and 61 days before the Retreat start date, Company will issue a refund of 75% of the Retreat cost paid by Participant, excluding the non-refundable Deposit.
  • If a cancellation notice is submitted between 60 and 31 days before the Retreat start date, Company will issue a refund of 50% of the Retreat cost paid by Participant, excluding the non-refundable Deposit.
  • If a cancellation notice is submitted 30 or fewer days before the Retreat start date, no refund will be issued.

You may transfer your Booking to another person upon our prior written consent. The transferee must meet all eligibility criteria and agree to these Booking Terms in writing.

5. Cancellations or Changes by Company

We reserve the right to make changes to the Retreat itinerary, schedule, accommodation, featured guests, or other aspects of the Retreat if reasonably necessary in our sole discretion. Such changes will not constitute a material breach of this agreement. If a material change substantially affects your Retreat experience, we may allow you to transfer to a future Retreat of comparable value. Refunds or credits will be processed within 14 business days of cancellation notice.

If we cancel the Retreat entirely due to low enrollment, travel restrictions, natural disaster, or other force majeure event, we will notify you as soon as possible and we will issue a full refund or offer a credit toward a future Retreat. “Force Majeure” includes, but is not limited to, natural disasters, government orders, pandemics, war, civil unrest, labor strikes, fire, flood, or other events beyond the reasonable control of Company.

We are not responsible for incidental costs incurred by Participant, such as airfare, insurance premiums, loss of income, or other related non-refundable bookings in the case of any cancellations or changes by Company.  We strongly recommend obtaining travel insurance.

6.  Retreat Guest Requirements & Obligations

  • Travel To & From Retreat Destination: You are responsible for booking and paying for your travel to and from the Retreat location.
  • Medical and Dietary Information: You must notify us of any relevant medical conditions, allergies, or dietary restrictions at least 30 days prior to the Retreat start date. We will make reasonable efforts to work with our locations to accommodate any communicated restrictions, but cannot guarantee that all requests can be fulfilled.
  • Conduct & Community Behavior: You must comply with all instructions and guidelines provided by Company and its staff. You agree to act respectfully, responsibly, and courteously toward other guests, hosts, vendors, and staff. We reserve the right to deny participation or remove any Participant, at our discretion, who violates these Booking Terms or whose behavior is disruptive, offensive, illegal, or endangers the safety, enjoyment or well-being of others, without refund.
  • Participant Property: You are responsible for the security of all personal belongings which they bring to the Retreat. Company will not be responsible for any lost, damaged or stolen Participant items.
  • Property Damage: You are personally responsible for any damage you cause to property at the Retreat venue or accommodations.  You agree to immediately report any pre-existing damage to a representative of Company and staff of the property as soon as possible upon discovery. You will promptly reimburse Company or the property owner for any costs (including repair, replacement and cleaning fees) arising from damage you cause upon request.

7.  Media Release & Use of User-Generated Content

  • Content Capture & Use Consent: By attending the Retreat or related events, you (i) grant Company permission to photograph, videotape and/or sound record you in connection with your participation in the Retreat; and (ii) irrevocably authorize and permit Company to display, publicly perform, exhibit, modify, alter, create derivative works, exploit and otherwise use your image, voice, name and likeness for any lawful purposes (including for any marketing and promotional purposes) on a perpetual basis, throughout the world, in any and all media, without further consent/approval from or compensation due to you.  If you object to being photographed or recorded, please email us at thefineprint@bookedsociety.com before your Retreat begins so we can make efforts to accommodate your preferences.
  • User-Generated Content: We welcome Participants to share photos and videos of their Retreat experiences online, including on social media websites, social media applications, and social sharing websites. If you post, share, tag, or otherwise publish content (e.g., photos, testimonials, videos, reviews) that relates to or depicts the Company (the “User Content”), Retreat and reference us (via tag or mention) or use any branded hashtags (e.g., #bookedretreat), you grant us a non-exclusive, royalty-free, worldwide, transferable, perpetual right and license to repost, display, reproduce, and use such content for promotional and marketing purposes without payment, royalties, or other consideration to you.  By granting us permission to use your User Content, you also grant us permission to use your name and/or social media handle in association with your User Content for identification related to the Retreat(s) and Company, and similar promotional purposes. While our general policy is to credit User Content, image/content credit is not guaranteed. You should only provide User Content that you are the owner of or have the right to license and you will ensure that your User Content does not and will not infringe, misappropriate or violate the intellectual property or other proprietary rights of any third party.

8. Assumption of Risk & Waiver

You acknowledge that participation in the Retreat involves inherent risks, including but not limited to: physical exertion, personal injury, illness (including infectious disease), emotional distress, travel delays, political unrest, natural disasters, and interactions with third parties. You voluntarily assume all such risks and agree to participate in the Retreat at your own discretion.  You further hereby agree to release, defend, indemnify, and hold harmless Company and its officers, representatives, directors, employees, successors, and assigns from any and all liability, damage, claim of any nature whatsoever arising out of or related to my participation in the Retreat, including any property damage or physical harm sustained or incurred, directly or indirectly, as a result of your attendance at or other access to the Retreat or Company events, or while traveling to, preparing for, attending and/or participating in the Retreat and/or any related activity (including any losses incurred as a result of any changes in the Retreat or Retreat event(s) date, time, location, whether or not such change is caused by force majeure or the acts of third parties).

9.  No Liability for Third-Party Services & Suppliers

Our Retreats utilize third-party providers and suppliers for accommodations, meals, activities, promotional items, or excursions. These third-party providers are independent contractors and entities, and are not employees or agents of Company. Therefore, we are not liable for the acts, errors, omissions, or negligence of any such third-party, including any injury, delay, or failure in performance by any providers or products.

10. Privacy

A separate Privacy Policy explains how we collect, use, and protect personal data collected from you in connection with your use of the Site and/or the services. The Privacy Policy and its terms and provisions are hereby incorporated and made a part of these Booking Terms by this reference. By booking and participating in a Retreat, you consent to our data practices as described in our Privacy Policy.

11.  Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMPANY BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PERSONAL OR BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF PERSONAL OR BUSINESS INFORMATION, OR OTHER LOSS OR DAMAGE) ARISING OUT OF OR RELATED TO ANY RETREAT OR BOOKING, EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR IF SUCH DAMAGES ARE OTHERWISE FORESEEABLE, AND REGARDLESS OF THE NATURE OF THE CAUSE OF ACTION OR THEORY ASSERTED (E.G., WHETHER IN CONTRACT, TORT OR OTHERWISE). IF, NOTWITHSTANDING THE PROVISIONS OF THE TERMS, COMPANY IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED TO YOUR BOOKING OR A RETREAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF COMPANY SHALL IN NO EVENT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE RETREAT. YOU AGREE TO USE YOUR BEST EFFORTS TO MITIGATE ANY DAMAGES OR LOSSES YOU MAY SUFFER IN CONNECTION WITH YOUR PARTICIPATION IN ANY RETREAT.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, parts of the above limitation may not apply to you. In such jurisdictions, the liability of Company shall be limited to the maximum extent permitted by applicable law. All other provisions of these Booking Terms remain in full force and effect.

12. Governing Law & Dispute Resolution

These Booking Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles. In the event of any dispute, claim, or controversy arising out of or relating to these Booking Terms, the parties agree to first attempt to resolve the matter through good-faith discussions. Each party agrees to provide written notice of the dispute and to participate in at least one good-faith meeting (via phone, video conference, or in person) within thirty (30) days of such notice. If the dispute is not resolved informally or through subsequent mediation efforts, the parties agree to submit to the exclusive jurisdiction of, and venue in, the United States District Court for the Central District of California or the Superior Court of the State of California, County of Los Angeles, for resolution. You waive any objection to such jurisdiction or venue, and waive any objections thereto including those of inconvenient forum or similar defenses.

13. Miscellaneous

The division of these Booking Terms into sections and the headings of the various sections in these Terms are for convenience of reference only and shall not affect the construction or interpretation of these Terms. You acknowledge and agree that any principle of construction or rule of law that provides that an agreement shall be construed against the drafter of the agreement in the event of any inconsistency or ambiguity in such agreement shall not apply to these Booking Terms. Our failure to insist upon or enforce strict performance of any provision of these Booking Terms shall not be construed as a waiver of any provision or right. There shall be no third-party beneficiaries to these Booking Terms. If any provision of these Booking Terms shall be held unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Booking Terms and shall not affect the validity and enforceability of any remaining provisions. These Booking Terms, together with our Privacy Policy, and all other documents incorporated herein by reference, constitute the entire agreement between the parties pertaining to the subject matter hereof and supersede any agreements previously existing between the parties with respect to such subject matter. Any provision of these Booking Terms that contemplates performance or observance subsequent to any expiration or termination of these Booking Terms, or which is otherwise necessary to interpret the respective rights and obligations of the parties hereunder, shall survive any expiration or termination of these Booking Terms and continue in full force and effect.
